Termination with Cause
A termination with cause occurs when your employer is terminating your employment because you did something wrong. This means that your employer does not have to pay you or offer you a severance package.
Conduct that an employer may rely on to terminate you for cause could include insubordination, gross incompetence, habitual neglect of duty, unauthorized absences, theft or fraud, dishonesty, lying to your employer during an investigation, breach of employer’s policies, or assaulting a co-worker.
If your employer has terminated you for cause, don’t give up. You might still be entitled to severance.

Constructive Dismissal
Constructive dismissal happens when your employer makes changes to a core aspect of your employment without giving you advance notice, or pay instead of notice, or without getting your consent to the changes.

How much severance pay am I entitled to?
The legislation sets out the minimum amount you are entitled to when you are terminated from your employment. However, you might be entitled to more than what the legislation says, also known as common law, depending on your employment contract. Your employment contract might have wording about what to expect if your employment is terminated. It is best to have your employment contract reviewed by the employment lawyers at Ertl Lawyers to determine what you might be eligible for.
Am I entitled to severance pay if I quit my employment?
Generally, no, you are not entitled to severance pay if you quit your employment. There are exceptions, however, depending on the reason why you quit your employment.
If, for example, you quit because you were experiencing ongoing harassment that you reported on several occasions to your superiors and they allowed it to continue. You may be entitled to severance pay in this situation.
Another example would be if you quit your employment because your employer told you that, effective immediately, your salary would be reduced by half. You objected to the reduction in your salary and your employer said too bad.
If you quit because you just didn’t want to work there anymore or you got a new job, you are not entitled to severance pay.
What is wrongful termination or wrongful dismissal?
They all mean the same thing, but it is most commonly referred to as wrongful dismissal. Basically, it means that your employer has terminated you without cause and did not provide you with a proper severance package. What makes the employment termination in Toronto “wrongful” is that you were not paid a good enough severance package. Does the reason for my termination matter?
If you were terminated for cause, then yes it matters. In order to be terminated for just cause, your employer has to meet a high burden to prove that there actually was cause to let you go, which means they have to give reasons.
If you were terminated without cause, then no it does not matter as much. The reasons, whether it be for restructuring, downsizing or elimination of your position, do not affect how much severance you are entitled to.
If you were terminated because of your age, sex, religion, etc., then it matters because it could potentially be a violation of the Ontario Human Rights Code.
